Foresee You, its subsidiaries, and affiliates (collectively, the "Company," "We," or "Us") thank you for visiting the online and mobile resources we publish. We use the words "you" and "your" to mean you, the reader, and other visitors to our online and mobile resources. Our privacy statement ("this statement," "this privacy statement," and "our statement") informs you about the identity of the data controller, the categories of personal information we collect, the purposes and legal bases for processing it, who we share it with and why, how long we keep it, the measures we take to protect it, and the rights you have over it.

This statement is established in compliance with Regulation (EU) 2016/679 of 27 April 2016 (the "GDPR"), the French Act No. 78-17 of 6 January 1978 as amended (the "French Data Protection Act"), and the guidelines of the French Data Protection Authority (the "CNIL").

"Online and mobile resources" mean the websites and other internet features we own that allow you to interact with us, as well as apps we've created and distributed to let our customers and followers view our online and mobile resources or otherwise interact with the content we provide.

WHO WE COLLECT PERSONAL INFORMATION FROM

We may collect personal information from the following groups of data subjects: visitors to, and users of, our online and mobile resources; our customers; current and former members of our workforce and those who apply for posted jobs; and third-party vendors and business partners.

"Personal information" (or "personal data") means any information relating to an identified or identifiable natural person, directly or indirectly (for example, your name, address, telephone number, email address, date of birth, or online identifier).

The categories of information we collect from each of these groups, and the ways in which we use it, differ. The same person could fall into more than one group. Most of this statement addresses our processing and sharing of personal information collected from visitors to and users of our online and mobile resources and our customers.

We also collect and retain the professional and employment-related personal information you would expect an employer to have about its existing and former workforce and new job applicants. We provide legally required notices and describe our use and sharing of such information in greater detail in confidential internal human resource manuals and documents, or on the proprietary workforce/applicant portals and apps we operate. Where such portals are operated by third parties, the legal responsibility to provide notice usually rests with the third party.

Like all corporate enterprises, we buy goods and services, lease equipment and office space, and attend industry events. In doing so, we process personal information limited to the business contact details of our vendors and business partners, in order to manage and perform under our contracts with them. We describe these processing activities in greater detail in our confidential contracts or on our internal vendor management portals.

WHAT WE COLLECT

We obtain, store and use two types of information: (i) non-personal information collected automatically from each visitor, such as your device operating system; and (ii) personal information that you voluntarily provide to us or that is collected automatically.

Voluntarily Submitted Information

If you participate in certain activities via our online and mobile resources, you may be asked to provide information about yourself. The categories of personal information we collect in those situations include identifiers (such as your name, email address, physical address, and phone number), professional information (such as the business you are in), and financial account information (such as your credit card information).

We do not sell, rent, or trade your personal information with third parties.

If you don't want us to collect this type of information, please don't provide it and do not participate in the activities that request it. Participation is strictly your choice. Not participating may limit your ability to take full advantage of the online and mobile resources, but it will not affect your access to information available to the general public.

Some of the ways you voluntarily give us your personal information and how we use it:

Emails and Online Forms – When you send us an email or fill out an online form, your email address and any other personal information in your message are retained and used to respond to you and process your request. Legal basis: performance of pre-contractual measures or our legitimate interest in responding to your enquiries.

Registering for an Account – When you register for an account (or a sub-account for your child, subject to the parental-consent rules below), you submit personal information such as your name and email address, which we retain to create and manage your account. Legal basis: performance of the contract.

Registering for Events – When you register for services, webinars, events, conferences, or programs we host ourselves, you submit the identifiers described above and, where a fee applies, financial information. Legal basis: performance of the contract.

Becoming a Subscriber to Our Service – We use information provided by our customers to perform our contractual obligations, provide the products and services purchased, manage their accounts, and communicate with them. Legal basis: performance of the contract.

Social Media and Community Features – Some of our online and mobile resources may offer community features letting users post messages or upload files. If you use these features, the information you post, including your screen name, will be in the public domain and not covered by this statement.

Automatically Collected Information and Cookies

When you visit our online and mobile resources, certain information is collected through tracking technologies such as "cookies," small text files downloaded onto your device that allow us to recognise it and store some information about your preferences or past actions.

In accordance with applicable law and the guidelines of the CNIL, cookies and trackers that are not strictly necessary for the operation of the site (in particular non-exempt audience-measurement cookies and third-party cookies) are only placed after we obtain your prior consent, expressed through our cookie-consent banner. You may withdraw your consent or change your choices at any time, as easily as you gave them.

Subject to your consent, we allow third-party vendors to use cookies to collect information about your browsing activities. For example, we use Google Analytics, a web analytics service provided by Google LLC ("Google"). Google Analytics uses cookies to help us analyse how you use our online and mobile resources. You can opt out of Google Analytics by installing the browser add-on available at https://tools.google.com/dlpage/gaoptout (compatible with Chrome, Firefox, Safari and Microsoft Edge). Legal basis: your consent (Article 82 of the French Data Protection Act).

The internet activity information collected through cookies and similar means includes: the domain name and IP address from which you accessed our resources; the type of browser and operating system you use; the date, time and length of your visit; the specific pages visited, graphics viewed and documents downloaded; and the links to and from other sites you used.

If you access our resources from a mobile device, your mobile services provider may transmit uniquely identifiable device information to us. If location services are enabled on your device, we may receive geolocation data. If you do not want us to collect and use geolocation data, disable location services through your device settings.

We use automatically collected information and mobile device information to compile generic reports about popular pages and to understand how our customers and followers access our resources, in order to administer, improve and enhance the functionality of our online and mobile resources.

Data Retention

We use and retain your personal information only for as long as necessary to carry out the purposes described above, in accordance with applicable law and our internal data-retention procedures. By way of indication: prospecting data is kept for up to 3 years from the last contact; contractual data for the duration of the relationship plus the applicable legal limitation periods; and cookie data for a maximum of 13 months.

User Beware: External Sites, Apps, Links and Social Media

We maintain a presence on external platforms such as X (Twitter), Facebook, YouTube, Pinterest, Threads, Instagram, TikTok and LinkedIn, and our resources may contain links to third-party sites or apps. We are not responsible for the content or privacy practices of those platforms, sites or apps, which have their own privacy policies and terms of use. We encourage you to read them carefully.

WHEN/WITH WHOM DO WE SHARE PERSONAL INFORMATION

We use non-personal information to administer and improve our online and mobile resources and to make business decisions. We use voluntarily provided personal information to respond to your enquiries and provide the services you have requested.

We do not sell or rent your personal information to third-party data vendors or marketing companies. We disclose your information when required by law.

Affiliates. We may share your information within our family of companies, including Foresee You, which will use it in accordance with this statement.

Legally Compelled Disclosures. We may disclose your information to government authorities or other third parties when compelled to do so by law, including in response to court orders and subpoenas.

To Prevent Harm. We may disclose your information when we have reason to believe someone is causing injury to or interference with our rights or property, other users, or anyone else who could be harmed.

Business Transfer. If we or any of our affiliates, or substantially all of their assets, are acquired through an acquisition, merger, sale, reorganization, consolidation, or liquidation, personal information may be one of the transferred assets.

Vendors and Business Partners (Processors). We may share your information with our vendors acting as processors within the meaning of Article 28 of the GDPR. We disclose only the information each party needs. These processors are bound by written contracts requiring them to use the information solely for the agreed purpose, not to disclose it without our instruction, and to implement appropriate security measures.

YOUR RIGHTS

In accordance with the GDPR and the French Data Protection Act, you have the following rights over your personal information:

the right of access to your data;

the right to rectification of inaccurate data;

the right to erasure ("right to be forgotten");

the right to restriction of processing;

the right to data portability;

the right to object to processing, including direct marketing;

the right to withdraw your consent at any time, where processing is based on it;

the right to issue directives concerning the fate of your data after your death.

To exercise these rights, contact us at [email protected]. We may ask you to verify your identity to prevent fraudulent requests. We will respond within one month, which may be extended by two months for complex requests.

If, after contacting us, you believe your rights are not respected, you have the right to lodge a complaint with the CNIL (Commission Nationale de l'Informatique et des Libertés, 3 Place de Fontenoy, TSA 80715, 75334 Paris Cedex 07 – www.cnil.fr).

Opting out of marketing. If you receive commercial communications from us (newsletters, product alerts) and no longer wish to receive them, you may unsubscribe by following the opt-out instructions in each communication (e.g., by replying "STOP" to a text), or by contacting us using the information below. Processing your request may take a short period. Some browsers offer a "do not track" feature; at this time, we do not respond to browser "do not track" signals.

TELEPHONE MARKETING AND OPT-OUT (BLOCTEL)

In accordance with Articles L.223-1 et seq. of the French Consumer Code, you have the right to register free of charge on the French telephone-marketing opposition list, Bloctel (www.bloctel.gouv.fr). We carry out prospecting by telephone, SMS or email only in compliance with applicable law and, where required, on the basis of your prior consent.

CHILDREN'S PRIVACY

Our online and mobile resources are not intended to be used by minors under the age of 15 without the prior consent of the holder(s) of parental authority, in accordance with Article 7-1 of the French Data Protection Act. We do not knowingly collect personal information from minors under 15 without such authorisation. If we become aware that data has been submitted by a minor in breach of these rules, we will delete it. We encourage parents and legal guardians to talk with their children about the risks of providing personal information over the Internet.

HOW WE PROTECT COLLECTED PERSONAL INFORMATION

We take all reasonable security precautions to protect your personal information. We have adopted a security program including technical, organizational, and administrative measures designed, in a manner consistent with industry standards and applicable law, to protect against anticipated or actual threats to the security of personal information (the "Security Program"). We cannot, however, guarantee absolute security during transmission or storage.

In accordance with Articles 33 and 34 of the GDPR, we maintain incident response and management procedures: in the event of a data breach likely to result in a risk to your rights and freedoms, we will notify the CNIL within 72 hours and, where required, the affected data subjects. Our processors are contractually required to notify us without undue delay of any breach affecting the data we provided to them.

CROSS-BORDER DATA TRANSFERS

Where we transfer personal information to a country outside the European Economic Area that does not offer an adequate level of protection recognised by the European Commission, we implement the appropriate safeguards required by the GDPR (in particular the European Commission's Standard Contractual Clauses) to ensure an adequate level of protection of your data.

LEGAL BASIS FOR PROCESSING

Depending on the purpose, we rely on: the performance of a contract or pre-contractual measures; your consent (non-essential cookies, direct marketing); compliance with a legal obligation; or our legitimate interest (improving our services, security, customer-relationship management), balanced against your rights and freedoms. We do not use your data for solely automated decision-making.

CHANGES TO THIS PRIVACY STATEMENT

This privacy statement was drafted on January 29, 2025, and is effective as of that date. We reserve the right to change or update it from time to time. Please check periodically for changes. The information collected is governed by the version of the statement in place at the time of collection.
